These Terms and Conditions (“Terms”) govern your use of otsmealprep.com and your purchase of meal preparation products and services from OTS Meal Prep (“we,” “us,” or “our”). By accessing our website, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

1. Acceptance of Terms

By using our website, browsing our products, or completing a purchase, you acknowledge that you have read, understood, and agreed to these Terms, our Privacy Policy, and our Refund and Returns Policy. These Terms constitute a legally binding agreement between you and OTS Meal Prep.

If you are using our website on behalf of a business, you represent that you have the authority to bind that business to these Terms.

2. Products and Pricing

All meal prep products are prepared fresh and are subject to availability. We reserve the right to modify or discontinue any product without prior notice. Pricing is displayed in US dollars and is subject to change without notice until your order is confirmed.

We make every effort to display accurate product descriptions, images, and nutritional information. However, we do not guarantee that all information is error-free. Slight variations in meal preparation, portion sizes, and ingredients may occur. Product images are representative and may not exactly match the delivered item.

Promotional pricing and discounts are offered at our discretion and may be modified or withdrawn at any time. Discount codes are subject to specific terms displayed at the time of offer, including expiration dates and usage limits.

3. Orders and Payment

When you place an order on our website, you authorize us to charge the payment method you provide for the total amount of your purchase, including applicable taxes and delivery fees. We accept major credit and debit cards processed securely through Stripe.

Order confirmation does not guarantee fulfillment. We reserve the right to decline or cancel any order for any reason, including suspected fraud, payment issues, or product unavailability. If we cancel your order after payment, we will issue a full refund to your original payment method.

You are responsible for providing accurate billing and delivery information at checkout. We are not liable for delivery failures caused by incorrect or incomplete addresses provided by the customer.

4. Subscriptions and Recurring Billing

We offer subscription meal plans that automatically renew based on the billing cycle you select. By enrolling in a subscription, you authorize us to automatically charge your payment method on each recurring billing date until you cancel.

You may cancel your subscription at any time through your account dashboard or by contacting us at info@otsmealprep.com. Cancellation requests must be received at least 48 hours before your next scheduled delivery to avoid being charged for that cycle. Cancellation stops future charges but does not refund orders already processed or delivered.

We reserve the right to modify subscription pricing, meal options, and delivery schedules. We will provide at least 30 days notice before any price increase takes effect. If you do not agree to the new pricing, you may cancel your subscription before the change takes effect.

5. Delivery and Shipping

We deliver to select areas in Southern California, including Los Angeles, Riverside, San Diego, Rancho Cucamonga, Long Beach, Murrieta, Temecula, Oceanside, and Palm Desert. Delivery schedules and availability may vary by location.

Delivery times are estimates and are not guaranteed. We are not responsible for delays caused by weather, traffic, or other circumstances beyond our control. If you are unavailable to receive your delivery, we will follow the delivery instructions you provided at checkout. Perishable items must be refrigerated promptly upon delivery.

We are not liable for spoilage or food safety issues that result from delayed refrigeration, incorrect storage, or failure to follow reheating instructions provided with your meals.

6. Food Safety and Allergen Disclaimer

Our meals are prepared in a facility that handles common allergens including dairy, eggs, wheat, soy, peanuts, tree nuts, fish, and shellfish. While we take precautions to prevent cross-contamination, we cannot guarantee that any meal is completely free from allergen traces.

Customers with food allergies or dietary restrictions are responsible for reviewing ingredient lists and allergen information provided with each product. If you have a severe allergy or medical condition, please consult your physician before consuming our products. OTS Meal Prep is not liable for adverse reactions resulting from food allergies or sensitivities.

7. Returns and Refunds

Our return and refund policy is detailed on our Refund and Returns Policy page. Due to the perishable nature of our products, we do not accept returns of food items. Refund eligibility is determined on a case-by-case basis for issues such as incorrect orders, damaged deliveries, or quality concerns reported within 24 hours of delivery.

8. User Accounts

To place orders or subscribe to meal plans, you must create an account on our website. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at info@otsmealprep.com if you suspect any unauthorized use of your account.

You must be at least 18 years old and legally capable of entering into binding contracts to create an account and place orders. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or unlawful activity.

9. Intellectual Property

All content on otsmealprep.com, including text, graphics, logos, images, meal descriptions, and site design, is the property of OTS Meal Prep or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or use any content from our website without our prior written consent.

Product names, meal names, branding elements, and marketing materials are trademarks of OTS Meal Prep. Unauthorized use of these marks is prohibited.

10. User-Generated Content

If you submit reviews, testimonials, or other content to our website, you grant OTS Meal Prep a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, publish, and display that content in connection with our business and marketing. You represent that you own or have the right to submit all content you post, and that it does not infringe on the rights of any third party.

We reserve the right to remove any user-generated content that we determine is inappropriate, offensive, or violates these Terms.

11. Prohibited Conduct

You agree not to use our website for any unlawful purpose or in any way that could damage, disable, or impair the site. Prohibited activities include, but are not limited to: attempting to gain unauthorized access to our systems, using bots or automated tools to place fraudulent orders, scraping content from our website, interfering with other users’ access, and uploading viruses or malicious code.

12. Limitation of Liability

To the fullest extent permitted by law, OTS Meal Prep and its owners, employees, and partners shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of our website, purchase of our products, or inability to use our services. Our total liability for any claim shall not exceed the amount you paid for the specific order that gave rise to the claim.

We do not warrant that our website will be uninterrupted, error-free, or free from harmful components. We are not responsible for any damages to your device or data resulting from your use of our website.

13. Indemnification

You agree to indemnify and hold harmless OTS Meal Prep, its owners, employees, and partners from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from your use of our website, your violation of these Terms, or your infringement of any third-party rights.

14. Dispute Resolution

Any dispute arising from these Terms or your use of our website shall first be addressed through good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to binding arbitration in San Bernardino County, California, under the rules of the American Arbitration Association. Each party bears its own costs unless the arbitrator determines otherwise.

You and OTS Meal Prep agree that any dispute will be resolved individually, and neither party may participate in a class action or representative proceeding. This arbitration agreement survives termination of your account or these Terms.

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any legal action not subject to arbitration shall be brought in the state or federal courts located in San Bernardino County, California.

16. Third-Party Links

Our website may contain links to third-party websites or services that we do not control. We are not responsible for the content, privacy practices, or terms of any third-party site. Accessing third-party links is at your own risk, and you should review their terms and privacy policies independently.

17. Force Majeure

OTS Meal Prep shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, weather events, supply chain disruptions, equipment failures, labor disputes, government actions, pandemics, or other emergencies. In such events, we will make reasonable efforts to resume operations as soon as practicable.

We may update these Terms at any time by posting the revised version on this page and updating the “Last updated” date. Your continued use of our website or services after any change constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

If material changes are made, we will notify customers by email or through a prominent website notice at least 30 days before the changes take effect.
